  • Solicitor-led advice from start to finish
  • Clear, plain-English explanations at every stage

Common questions

Wills & probate, answered plainly

When someone dies without a will they are said to have died 'intestate'. The estate is then shared according to the rules of intestacy, which set a strict order of who inherits. We can explain exactly who is entitled and help you apply for letters of administration to deal with the estate.

A grant of probate is issued when there is a valid will, authorising the named executors to act. Letters of administration are issued when there is no will (or no valid one), authorising the next of kin to administer the estate. Both give legal authority to deal with the estate — we handle whichever applies to you.

It varies with the size and complexity of the estate, but a straightforward estate often takes around six to nine months. Estates involving property sales, inheritance tax, or disputes can take longer. We will give you a realistic timeline for your specific situation at the outset.

Disputes can arise over the validity of a will, its interpretation, or how the estate is distributed. We advise sensitively and work to resolve matters without conflict where possible, while being ready to protect your position robustly if it becomes necessary.

You may be able to contest a will on grounds such as lack of capacity, undue influence, or improper execution — or make a claim if you were not reasonably provided for. There are strict time limits, so it is important to seek advice early. We can assess your position and explain your options.

Many probate applications can now be made online, which can speed things up. We manage the application for you either way and make sure it is completed correctly, so there are no avoidable delays.

Yes. Estates that include assets abroad add complexity — different countries have their own rules, and additional steps may be needed. We can guide you through how foreign assets are dealt with as part of administering the estate.
